I was asked to research into why a number of people at LDOE are suddenly getting promotions. Apparently over the last few months a dozen or so jobs have popped up on the Civil Service job posting site with very narrow application time frames (less than a week). These postings say they are only accepting internal applicants. Within a short time frame new folks go to new jobs with decent raises while the rest of the department goes another year without raises. It was hypothesized that this was being done to secretly reward and situate folks before John White left.

. . . last Friday LDOE posted a buttload; about 8. This is the most simultaneous postings I remember seeing. These are all higher ranking classified positions (mostly EPC 5s) on the Civil Service website. In fact one was posted Thursday and expires tomorrow at noon. These are mostly promotional so not open to external applicants. They were posted with only 5 calendar days (including the 2 weekend days) to apply. This was done to promote people internally – many of whom were recently brought in by this regime.  Looks like 1 or 2 are being promoted but doing the same work, but most of them are (EVEN MORE) brand new management positions.

And they continue to make jobs for their friends in the reform business. We can’t get a raise and they continue to make jobs for some. There is another reorg in motion with more (I think) than the allowed number of assistant supes. And yes there are interns all over. They even plan to have get togethers for them- I guess to brainwash. We’ve have a different one each year for the past 4 years.

I did not expect LDOE to be particularly forthcoming on furnishing me details about what was going on so I requested some payroll files for this year and last year from Civil Service. Those are public records and various local newspapers request and post salaries for all state workers from time to time in searchable databases.

In the Special School District there were no promotions and only 4 of the 105 employees they had employed on June 30th of 2013 and June 30th of 2014 received raises. It appears these were not based on promotions but some other factor external to the data I received. Possible factors are nepotism, favoritism, blackmail or bribery, new duties not encapsulated in their employment records and titles, or simply because these individuals have skills or knowledge that would be expensive to replace.

One of the reasons agencies are not supposed to limit raises to a very small subset (and to be completely transparent about how some folks get raises and others don’t) is out of concern for the first set of reasons becoming significant factors in retaining employees. Obviously situations where a slim subset of favored employees are getting special treatment is a form of corruption and not healthy for public or private entities. Prolonged use of these types of practices will leave us with agencies filled with employees getting jobs and keeping jobs strictly because of who they know, (not what they know or what they do.) Civil Service was established to ensure a fair playing field for State Employees and to prevent this exact good ole boys network – which historically was a serious problem for Louisiana. However despite Jindal’s ethics reform claims to fame, Civil Service has been abused and castrated under Bobby Jindal’s administration and is unable to ensure equitable and fair treatment for State employees in many cases – particularly in regards to hiring, firing(layoffs) and compensation. These types of exclusive compensation situations are a concern for me, and should be for you. I am not saying the 3% of employees that got raises (despite being in the same jobs) have done anything wrong but I have a feeling that at least some of 101 employees, the other 97%, deserved to make at least the same money when tied to the inflation index. What happens when you don’t pay your employees is you lose them, and with them all the money you invested in them and all their institutional knowledge – which is often irreplaceable. When you stop paying state employees competitive wages you are asking them to subsidize the government your elected officials have constructed.

This brain-drain happened at LDOE with significant consequences. Local funding is constantly being miscalculated, data is handled carelessly, disabled students are treated illegally and not protected, and opportunities for grand and costly mistakes become more likely – if not inevitable. Of course what also happens is that employees like myself and Tom Aswell at Louisiana Voice also leave and air our agencies dirty laundry, so maybe there are some upsides to the general public for abusing civil servants for political gains. J However I assure you this is a dangerous and unstable situation. I agree that we have probably have too much government in many areas in the State and Nation, but punishing folks that have dedicated their lives to serve you and your families is not the way to make things better for anyone. Many of the abuses, scandals and wastes in government are a result of the folks we elect, like failed Congressional candidate Neil Riser (who despite Jindal’s shady shenanigans lost to the Kissing Congressman Vance McAlister)who appears to have secretly passed a law to benefit the retirement of a personal friend, State Police Superintendent Edmonson, to the tune of 55,000 per year (nearly twice what most employed state workers make) Denying raises to most state employees, except favored ones, is like attempting to treat the symptoms of a scraped knee with sandpaper, instead of treating the root cause – which is often our elected officials voting for things we can’t or shouldn’t be paying for – like continuing to provide corporate welfare for corporations that fail to create the new jobs they promise, and pricy pension amendments for the well connected.

In the Recovery School District 34 of 169 employees received raises. The vast majority of these raises were not based on promotions but some other factors not revealed by the data. It appears one employee must have been on administrative leave and earned no salary in 2013 so they saw the biggest increase.

Frankly I’ve never worked anywhere that did not provide raises or bonuses at least annually and I would not stay anywhere that did not at least keep up with inflation. I have a family and couldn’t afford it as I’m sure most of these state workers do too. I’ve gotten raises or bonuses more frequently in the public sector jobs where I’ve been employed. Of course you probably don’t need a raise for a while if you come in making close to or over six figures – with just a couple years of experience as many of John White’s hires often do.

This discovery has made me wonder what DOA (Jindal’s right hand) and the Governor’s office is doing so I shall inquire there next for comparison purposes. . .

Of course most of you probably clicked on this link to find out about LDOE. I would be remiss to leave you without answering some of your questions. I can’t be sure, but I did not find a lot of evidence to support the claim that TFA types are reaping all the rewards of the latest slew of promotions and salary increases. (That’s not to say they aren’t already well and perhaps overly compensated) I actually recognize several of the names of those who were promoted (several paygrades.) In some cases this is most likely a necessary result of the vast purges LDOE did since John White took office. After the dust settled, John White and his staff discovered they had done such a good job eliminating mid-level managers that they actually had very few left to handle the day to day operations. Most of those getting promotions probably are doing much the same jobs as they were before, because they were probably acting as the senior staffers in those positions due to the lack of any other experienced staff left. LDOE hires numerous “executive” managers and assistant superintendents and directors from the ranks of TFA and the politically connected, but those folks are vastly unqualified for the positions they are placed in. This is why you won’t find an up-to-date phone list or e-mail listing for most of these groups, because they aren’t capable of answering questions on their own and need to consult with the few experienced LDOE employees left behind. To ameliorate this situation for school districts concerned citizens I have decided to provide a listing of all employees for LDOE sorted by workgroup and salary. It’s amazing how close this is to precisely defining organizational structure of LDOE. So there you have it folks. If you need to reach a staffer at LDOE you can use this list to identify who you should be talking to. There is no guarantee they will talk back of course, but at least now folks have some idea of how the department is organized now. That has been a very frequent complaint which I hope I have helped address.

BESE member Jay Guillot’s company paid $1.5 million for work for RSD, South Louisiana school boards in 2013-2014

Unethical behavior appears to be the norm, not the exception, for BESE. I would most certainly be out of place if I got elected.

One of the most frustrating things in writing about this administration is obvious wrongdoing is reported and nothing is done.

In Bobby Jindal we have a governor who is constantly bitching about Washington in general and the Obama administration in particular while turning a blind eye to corruption, profiteering and ethical violations within his own administration.

You would think that the man who, upon taking office in 2008, said, “We have zero tolerance for corruption” would make at least a token effort to keep his house in order.

Instead, he gutted the enforcement authority of the State Ethics Board, ran off members of the board, and commenced to allow his political pals to run unchecked.

The sordid episode of State Police Superintendent Mike Edmonson and the manner in which he was allowed to increase his state pension by nearly 70 percent is just the latest in a sorry laundry list…

Update On the “100 Summer Interns” Story

It took some detective work, and reviewing of records from other agencies, but I was able to locate 16 summer interns and 14 student workers on LDOE’s payroll for a total of 30 student workers employed this summer. That’s still a lot of kids roaming around the halls of the department so I can see why it might seem like 100 interns. The highest paid interns earned 20 dollars per hour or the equivalent of around 40k if they were paid annually. The total payroll for all student workers comes to around 350k. All 30 student interns make up about 7-8% of LDOE’s total workforce as of July 2014. LDOE had contracts for at least 5 of their summer interns which I was able to uncover which LDOE did not turn over to me in response to my records request. All of these contracts would now exceed the 2k limit Bobby Jindal has now placed on the Louisiana Department of Education, which I would advise he keep in place indefinitely. If a state department can’t keep track of their own contracts they certainly should not be issuing them. I’m still not quite sure why LDOE refused to supply any information for my very reasonable Freedom of Information request and instead chose to wait two weeks before responding that they had no records responsive to my request.

I noted a few of the student workers and interns are children of current and former employees, but they are making the least amount – barely above minimum wage. I have chosen to withhold the actual names of the student workers and summer interns from this piece but listed below are the areas they are assigned to in the department.

Since I ran my story on the interns LDOE has been slightly more responsive to my inquiries on other issues which was what I hoped would happen when I published the information I had received in tips. LDOE refused to admit to having any records on summer Interns when I sent them a snippet of their own newsletter (one of several they sent around) announcing these interns. At the very least they should have provided me the newsletters and contracts they had in their possession and which now I have in mine. As for my other stories. . . I think you will be surprised and dismayed to learn what I have been able to deduce from information recently released to me. In some areas it is not as bad as I feared, but in others it is worse. Now I have the actual data to support many of the arguments I have been making over the last few years in regards to RSD, dropouts, graduate counts and charter schools. I much prefer cold hard data (or even the warm squishy data LDOE produces these days which I choose not to speculate on the origins of) over rumor and innuendo. . . but I am also not content to allow LDOE to continue to hide behind a veil of secrecy and reflexive denial as appears to have occurred in the Intern situation.

I am still waiting on some requests to be forthcoming but since the response times have dramatically increased lately I feel comfortable I’ve given the department enough time to respond to my inquiries about press releases they produced two weeks ago.

Still Waiting in Lines, Nine Years Later

One of the tragic truths behind all the hype about choice. Congrats to all tbe Reformers for extending the tragedy of Katrina out 9 years later and still going. I can’t wait till i can queue in lines all day like they used to have in communist Russia to try and enroll my kids in school only to be turned away and told to try again tomorrow. What a choice.

I have flash back from Katherine when we had to stand in line for food &water for our children in the heat now we have to do it for education . If I Don’t Laugh I’ll Cry

It’s hard to argue that Kevin Huffman does not deserve to be laughed out of Tennessee after getting on NPR with Arne Duncan on June 24th to proudly declare the only thing holding disabled children back academically were low expectations and insufficient testing. So i won’t. What I will say is that White has done more than just say stupid things, he has lied on camera and before BESE, TV reporters, and the legislature numerous times on many issues. He has engaged in behavior that appears criminal in nature but is at least morally and ethically bankrupt. He is at odds with Governor Jindal and actively fighting his Governor in the media with with lawsuits, not being doggedly defended like Huffman is by his Governor now. Even John White’s contracting wings have been clipped with a reduction of his self-approval power dropping from 50 or 25k (depending on who you ask) to just 2 k. (My guess is White will get around this my issuing 25 2 k contracts to vendors) I wish Tennessee well in their quest to rid themselves of their education deformer, but I think John White has a pretty significant lead in stamping his own walking papers. Some of my friends are placing bets on White’s last day and hour on Facebook. I’m not quite that confident, but I would start taking home some personal items, if I were White… and i would definitely be looking for a new state to relocate to that had not heard of me yet. I hear Ukraine is looking for some new blood, and corruption is supposed to be their forte… White would fit right in.

thTPUTENR3As you may or may not know, Kevin Huffman and John White are in a race to see who can reach Chiefs for Change Emeritus status first. After reading a series of posts by the respected Crazy Crawfish (https://crazycrawfish.wordpress.com/2014/06/30/the-news-just-keeps-getting-worse-for-supt-of-ed-john-white-state-auditor-investigating-possible-payroll-fraud/) I thought John White had the clear advantage. I should not have underestimated the esteemed Kevin Huffman. He’s not going down with out a fight.

Its been a busy couple of weeks. We’ve covered the delayed test scores and the “post-equating”. About 2 week’s ago 15 State representatives sent a letter to Governor Haslam questioning the legality of the commissioners granting of waivers. After all a clause in the recently passed legislation clearly seemed to say he didn’t have that authority. Governor Haslam shrugged and said he hated cheap parlor tricks and that he hadn’t had time to even think about changes to his cabinet due to the upcoming election.

This is my response to the latest buzzword “Clarity” that came out of the BESE meeting July 1st.  If you found that meeting as frustrating as I did, I think you will find this parody amusing. I also get to take out some long overdue vengeance on some well known reformers and paid off Common Core supporters or profiteers.  What could be more awesome than that?

Plan B: One-Step for Addressing PARCC and Common Core

Today was an interesting day at the Claiborne building in downtown Baton Rouge. Today was the much anticipated climax of significant back and forth politicking between Governor Jindal and his mail ordered State Superintendent of Education, John White. Today was the day Louisiana got a front row seat to the attempted abortion of the illegitimate Education Love Child known as Common Core and the testing consortium known as PARCC, conceived in back room deals and between these two star-crossed (and now double-crossing) education reformers.

Of course John White insisted on boring and dubious analysis of the situation that everyone who was there already knew all too well. Usually this is simply annoying and infuriating, but today was a little different since he didn’t have a trusty and redundant PowerPoint to stall over and guide him through the highlights. It appeared White was talking somewhat off the cuff. When you talk for hours on end you eventually make some mistakes. When you lie about everything to everyone, it is inevitable that you will contradict yourself and your previous statements.

Let’s discuss some of them.

John White confirmed that the test questions for next year will be different than this year and that test questions always change every year, regardless of who cast the testing contract and regardless of the test containing PARCC questions or not. This contradicts John White’s earlier testimony and assertions to the legislature related to disclosing previously administered tests to parents to review. White claimed this would cause a lot of unnecessary expense and force the department to create new questions. When White testified before the legislature this spring he claimed if test questions were released the tests would need to be reworked because those questions could never be used again. However today, before BESE, John White confessed these questions are changed every year. They are not used every year anyways so releasing these tests should not be a problem, right? Inadvertently he defeated his own argument against allowing parents to review the exams being administered to their children.

Today John White made an assertion that the current environment is very confusing and clarity was needed for teachers, parents and students. (Who wouldn’t agree with that?) He claimed this clarity could only be achieved by seeking a legal expert, seeking a legal opinion and filing a lawsuit to resolve the legal conflicts between BESE, LDOE and the Governor’s office. He was partially correct. What is going on is very confusing. Bobby Jindal and BESE conceived this chaos 4 years ago today when they adopted Common Core without it being finalized. John White midwifed Common Core for Jindal and BESE, but then snuck around on the state and cheated on us, conceiving a PARCC contract during his philandering with other reform organizations. White tried to pass off PARCC as the governor’s offspring by adopting it through an old non-bid contract. White thought he could force Louisiana and Jindal to adopt PARCC and pay to support this progeny of his relationship with CCSSO and the PARCC board – both organizations he holds leadership positions with. White obviously wants to hold onto these relationships, while also courting Louisiana and Jindal as the sugar daddy that will pay for him and them. Where John White was incorrect was in his proposal for resolving this conflict in time to bring clarity to our teachers. I have never heard of a situation where bringing lawyers and lawsuits into a dispute resolves that situation quickly. White also claimed lawyers and lawsuits will bring clarity. . . Maybe in a few years. . . but school starts up next month. Can anyone say with any confidence getting lawyers involved with resolve this situation swiftly or with clarity in the next few weeks? This is a recipe for complete disaster; one which John White could mitigate by simply putting everything on hold while these questions are resolved to the clarity level he feels comfortable with.

John White previously made the statement that there was no Plan B, because there was no legal option no Plan B was conceivable. Today however White backtracked and not only admitted that he had a Plan B, but that the situation is beyond his legal expertise and does not look like it will be resolved before the start of the school year. That’s why he and BESE President Chas Roemer are seeking legal experts. . . because they recognize this is a complex situation that will need to be decided in the courts based on the decision made by Jindal, John White and Chas Roemer. That was the ultimate decision of today’s meeting; to acquire the services of legal experts to council and perhaps file a lawsuit. This decision to make this issue complex is entirely John White’s and Chas Roemer’s, but they will not be the ones that have to bear the brunt of their decision. Teachers will be impacted. Students and parents will be impacted. Just about everyone but the ones creating this chaos will be harmed by the confusion they have chosen to sew into this situation. They are content to consult a lawyer and point their finger’s a Jindal while this slow moving train plods towards the August cliff of the imminent school year.

When you find yourself in a hole, and decide you need to get out, you stop digging. Before implementing new changes that may harm one of the parties, judges initiate injunctions to prevent either party from proceeding while the courts resolve the differences. As was brought up multiple times during today’s BESE session by BESE members Lottie Bebee, Jane Smith and distinguished educator and blogger Michael Deshotels, Louisiana had some of the highest regarded, nationally recognized standards in the nation. They were defined as one of the top 2 sets of standards in the United States. We used them for the most part last year and all the years before. We have those standards to rely upon while we await the rulings John White and Chas Roemer feel we need to bring clarity to this situation. We have our tests from last year that were aligned with the current curriculum. We spent quite a bit of time and money developing them. They contain some questions based on the national standards White and Roemer claim we are obligated to benchmark our tests against. We can stay the course while the courts resolve these questions Roemer and White claimed multiple times they are unqualified to clarify for themselves without involving lawyers and filing lawsuits. We adopted these standards 4 years ago blindly and without any input from parents – because they weren’t finalized and there was nothing to comment upon. Now that we have seen these standards implemented parents see they are worse than what we had. Education Reform has put our state in hole and riled up parents across the state to reject this corporately driven and funded agenda of which PARCC and Common Core are a significant part. The hole we find ourselves in is just getting deeper and less stable. Even our political leaders can’t decide among themselves what to do without resorting to lawyers. This was a mistake born of too much inexperienced enthusiasm without enough thought towards consequences or protection. It’s time for plan B. It’s time to stop digging. After 4 years, it’s time to stop screwing around with education and start being responsible.
